If, despite clause 8, a book is
returned that book will be held by First and Best pending payment of the amount
due, and the book will be returned only after the sum due has been paid. Your attention is particularly drawn both to
clause 8 above and clause 13 below. First and Best gives particular attention to the way in which its advertising
is written to ensure that each advertisement for a book represents a reasonable
and fair description of the book. Should you feel that this is not the case with a particular book you
should in the first instance write to First and Best with your comments before
returning the book so that the matter can be fully investigated.
10)
Many of the books that are supplied
by First and Best include a licence to copy the materials. In all cases this licence only allows copying
for use within the school or college that purchases the materials. The books may not be copied for use in any
institution beyond the institution buying the materials. Also no part of the book may be put on any
internet or intranet site or any similar system without permission in writing
from the publishers. Ordering of the
book is deemed to be a sign of acceptance of this specific restriction on the
use of the book. Software supplied via
this site is supplied for use on a single machine. A separate site licence is required where the
school or other body wishes to use the software on more than one machine.
11)
Teachers who are buying books on
behalf of schools may opt to have the school pay on invoice. Where an individual does select this option
it is inherent within the order that the individual is acting with the
knowledge and agreement of the school.
12)
In the event of the goods not
arriving within 28 days of the order being placed the school must contact First
and Best and report the failure. Such
reports should be sent to sales@firstandbest.co.uk
13)
All invoices issued in accordance
with clause 11 are sent to the school with the goods, and will be payable
within 30 days of the date on the invoice. Where payment is not made and it becomes necessary for First and Best to
proceed to court in order to recover the sum due First and Best will be
entitled to claim the invoice value of the book plus the delivery charge, the
court fees involved in bringing the matter to court, plus interest at the rate
of 3% per month for each month or part thereof from the date of purchase.
These
conditions are governed by and construed in accordance with the laws of
England
